Irregularity Report Form

The form is used for anonymous reporting of irregularities at MECHANIKA MASZYN KACPEREK

§ 1. General provisions

1. The procedure of anonymous reporting of irregularities at Mechanika Maszyn Kacperek defines the rules and methods of reporting violations of the law, including violations of Regulation 596/2014, Regulation 600/2014, the AML Act as well as procedures and ethical standards applicable in the company.
Abnormalities - violations and potential violations of the law, including Regulation 596/2014, Regulation 600/2014, the AML Act as well as procedures and ethical standards in force in the company,
2.     Regulation 596/2014 - Regulation (EU) No 596/2014 of the European Parliament and of the Council on market abuse (market abuse regulation) and repealing Directive 2003/6 / EC of the European Parliament and of the Council and Commission Directives 2003/124 / EC, 2003/125 / EC and 2004/72 / EC,
3.     Regulation 600/2014 - Regulation of the European Parliament and of the EU Council) No. 600/2014 of May 15, 2014 on markets in financial instruments and amending Regulation (EU) No. 648/2012,
4.     AML Act - Act of March 1, 2018 on counteracting money laundering and financing of terrorism.

§ 2 Reporting irregularities

1. Reported Irregularities must relate to violations and potential violations of law, including regulation 596/2014, regulation 600/2014, the AML Act and ethical standards in force in the company.
Any person who has information about Irregularities may report it in an anonymous manner via the following website: www.kacperek.pl/whistleblowing
2. The notification should include an indication of the Irregularities (detailed description) and an indication of the persons responsible for the occurrence of the Irregularities. 
3. The company provides employees who report violations with protection against repressive actions and discrimination. Submitting the report may not be the reason for the termination of the employment contract, transfer to another job position or change in the scope of duties of the employee reporting the irregularity.
4. Personal data of the employee submitting the report of Irregularities and the person who is accused of infringing, are protected in accordance with the rules of the GDPR in force in the company, and are also processed in confidentiality by the employees involved in considering the notification. These data are not made available to other employees, except for persons to whom the data should be made available in order to fulfill obligations resulting from legal provisions.
The data of the person who is accused of infringing, unless he was or is not an employee of the company, may be processed only for the purpose of fulfilling the obligations arising from the notification.

§ 3 The Commission for Counteracting Irregularities

The Irregularity Prevention Committee consists of:
Proxies
Human Resource Employee
Health and safety inspector
Lawyer - for applications that require it.
In the event that there is a likelihood of any Irregularity, the Committee draws up a protocol and takes corrective actions.

It is possible to pick up orders from the branch in Łomianki outside the working hours of the sales department after prior agreement with the merchant conducting the order. No prior agreement may result in the goods not being ready for collection.
